一般人格权在人格权体系中的价值分析-value analysis of general personality right in personality right system

构中进行了系统的分析，首先明确了人格权是一般人格权的上位权利，一般人格权与具体人格权并列处于人格权的下位。然后论述了一般人格权与具体人格权之间的关系，主要从本源与派生、既定和补充、一般与特殊、相互并存等方面进行阐释。将一般人格权在人格权体系的定位厘清之后，笔者详尽探析了一般人格权在人格权体系中的重要功能：解释功能、创设功能及补充功能。在第三部分中，首先从我国现有的一般人格权立法现状出发，指出我国现行立法缺乏一般人格权的明确规定，没有完善的一般人格权制度，并列举了当今社会需要面对的若干一般人格权保护的问题，提出因为一般人格权制度的缺位，导致人格权司法实践中面临的困境，表明了建立一般人格权制度对人格权体系完善的重要意义。关键词：人格权；一般人格权；具体人格权；定位；功能AbstractWiththedevelopmentofmodernsociety，Humanbeingspaymoreandmoreattentiontotherightsandinterestsofoneself；Atthesametime，Thecomplexionofstructureofthesocietycausethattheriskofpossibilitypersonalityrightsbeinfringeduponisincreased.Asa“lawforhumanbeings”,Civillawshouldprotecttherightsandinterestsofthenaturalpersonandallkindsoflegalpersonsandendowitcertainprovisionsandrelief.Intheoryandpractice,thecreationofgeneralpersonalityrightbyGermanyjudicialisthemostoutstanding.Andarguingandresearchofthepersonalityrightsproblemsneverstoppedatallcountriesonthegenerallaw.Chinabelongstothestatestatutes，Theprotectionofcivilrightsisstatutory,can’tsatisfyfull,timely,comprehensiveprotectiontothepersonalityrights,Needtheconceptofgeneralpersonalityrighttocomplementandperfectpersonalityrightsystem.Therefore,inthepersonalityrightssystem,clearingthevalueandfunctionofthegeneralpersonalityrights,fortheotherproblemsresearchofgeneralpersonalityrights,legislationconfirmationandthejudicialpractice,allhasthesignificantpracticalsignificance.ThisarticlebasedontheresearchsituationofChinasgeneralpersonalityright,usehistoricalanalysis,comparativeanalysis,putthegeneralpersonalityrightintothepersonalityrightsystemtostudyit.Inthefirstpart,thewriteranalyzesgeneralpersonalityrighttotheconcept,characteristics,historicalevolution,natureandcontent.First,explainsupperconceptofgeneralpersonalityright:personalityandpersonalityright,andthenbythecomparisonofrepresentativedomesticandoverseasscholarsviews，afterabriefcomments，pointsoutthatgeneralpersonalityrightisthegeneralcharacterequality,independentpersonality,dignity,freedom,andallpersonalityfactorsofbasicrights，whichenjoyedbycivilm
