AbstractWithconstantlyenrichmentandperfectofthecivilrightsystem,thegeneralpersonalityrightgraduallygainattentionandgotrapidprogress.Disputesinvolvedthegeneralpersonalityrightinpracticeappearfrequently,butthegeneralpersonalityrighthasnotspecifiedinthelegalsysteminourcountry.Duetothelitigationsystembasedonthesubstantivenorm,thelackofsubstantiverulesmustcausetheapplicabledilemmaofprocedurallaw,onthetopofthelististhedilemmaofexercisingthelitigationrightastheconnectionbetweensubstantivelawandprocedurallaw.Itiscriticalthatgivingtheprocedurallawfullplaytorespondtorightsprotectionrequestfromtheparties.Thispaperaimsatfindingoutwaysofperfectingthelitigationsysteminordertoprotectgeneralpersonalityright.Thedefinitionandscopeofgeneralpersonalityrightisthebasement,supplementedbylitigationrighttheoryanalysisandtheprotectionofthelitigationrightincivillawcountriesandcommonlawcountrieswillbediscussed.Excepttheintroductionpart,thispaperisconstructedbyfiveparts:Chapteronedefinestheconceptandscopeofgeneralpersonalityright.Throughcontrastingvarietyoftheoriesofthegeneralpersonalityright,theauthordefinesthegeneralpersonalityrightas:arightwhichprotectsthegeneralpersonalinterest,whichisthefoundationofprotectingthelitigationright.Chaptertwogivesabriefintroductionoftherequirementsofgeneralpersonalitylitigationright.Throughcombinghistoryoflitigationrighttheoryandanalyzingeverytheoryoflitigationrighttoshowthedevelopmentoflitigation,thispassageclarifiestherightrequestsrequirementsoftherightprotectionrequeststheoryandfurtherpointsoutthefactorswhichinfluencegeneralpersonalitylitigationrightaccordingtothedebateongeneralpersonalityright.Chapterthreestudiesthelitigationrightprotectionsystemofthemainexoticcountries.Throughcomparativestudyonthelitigationrightprotectionsystemofthemaincountriesofthecivillawandthecommonlaw,thispassagespecifiestheadvantagesthatareneededtoimprovelitigationrightprotectionjustinordertoperfectthetheoryresearchandpracticeconsultationofthegeneralpersonalitylitigationrightbasedont
