100 法律科学(西北政法大学学报) 2009 年第 6期 : 1674 - 5205( 2009) 060 100( 005) 高永明 (扬州大学法学院, 江苏 扬州225009) ∀ # 我国刑事责任是犯罪的后果, 具有静态性, 无法反映可谴责性成立的过程, 这是由二元 立的本质 主义思维方式决定的大陆法系刑事中, 责任的概念与犯罪是同 一的, 责任以犯罪成立的方式存在, 责任的罪责要 素贯穿于犯罪成立的三 个条件中, 责任塑造了犯罪构成, 因此责任反映出可谴责性成立的过程, 其过程性动态性 特征尤为明显这是由西方整体主义思维方式决定的在犯罪论体系重构以及中国义务本位发生转变的情况下, 刑事责任研究的思维进路必须被改变, 使得对其研究进入真正的问题域, 从而改变刑事责任在刑法中地位弱势和 内容空洞的状况, 祛除没有学术价值的无谓争议 ∀# 刑事责任; 思维模式; 结果性地位; 过程性地位 A bstract: In Ch ina, the static cr mi ina responsibi ity is the consequences of the crmi e, and it cannot ref ec t the process o f the denounce. It is dec ided by the thought o f the essentia ism. In the c iv i aw countr ies, the concept of cr mi ina responsib i ity and cr mi e is sam e. T he ex isting w ay o f the cr mi ina responsib i ity is through the w ay that ex istence o f crmi e. The e em ents of the cr mi ina responsib i ity penetrates the process of the cr mi e constitution, and it shapes the cr mi e constitu tion, therefore, the crmi ina responsibi ity ref ects the process of the crmi e constitution, and it is processing and dynam ic w hich is determ ined by the thought o f the ho ism.
