Exploitation,discrimination,andviolenceagainst

migrantworkersoccurinemploymentsettings

worldwide,throughoutallphasesofmigration,in

variousformsincludingexcessive(andillegal)fees,

unethicalrecruitmentpractices,contractsubstitution,confiscationofidentitydocuments,restrictionson

movement,overwork(insufficientrestperiods),poorlivingconditions,wagetheft,conditionsresemblingforcedlabourorslavery,andbothphysicalabuseandsexualandgender-basedviolence.1

Inearly2024,theInternationalLabourOrganization(ILO)conductedaresearchstudyonthelegal

framework—laws,policies,institutions,and

procedures—relatedtorespecting,protecting,and

promotingmigrantworkers’rightstoaccessjusticeforhumanrightsviolations.ThestudyevaluatedthelegalframeworkconcerningKenyanmigrantworkerswhofacerightsviolationsathomeorabroad,aswellastheframeworkconcerningmigrantworkersexperiencingrightsviolationsinKenya.Thegoalwastomake

evidence-based,country-specificrecommendationstoimproveaccesstojustice,includinglegalmechanismsandoutcomesformigrantworkers—especiallylow-skilledworkers,whoareoftenthemostvulnerable—withinandfromKenya.

Theresearchstudyculminatedinacomprehensive

challengesfacedbymigrantworkers,anexaminationoftheinternationalandregionalnormativeframework,athoroughreviewoftheexistingdomesticlegal
