沈阳师范大学学士学位论文 网络直播平台的政府监管问题研究 PAGE PAGE II 沈阳师范大学学士学位论文 网络直播平台的政府监管问题研究 PAGE PAGE I 摘 要 2016年我国迎来了“网络直播元年”，网络直播平台数量剧增，网络直播行业喷井式发展，2022年新冠疫情的爆发，我国更是迎来了全民直播的新时代。然而，在网络直播行业快速发展的同时，也出现了各种各样的网络直播乱象，政府作为网络直播平台的重要监管主体，对各方面的监管发挥着主导作用。当前在网络直播平台的监管过程中，政府监管部门虽然在打击违法现象、整顿直播行业过程中取得了一定的成果，但在法律法规建设、监管机制、监管手段等方面存在着明显的缺陷与不足，笔者通过总结分析政府在网络直播平台监管存在的各项问题，在借鉴国外先进经验的基础上，提出了不断完善我国法律体系建设，强化主体责任落实，创新监管手段，形成由政府、企业、社会共同组成的联合监管体系等建议，实现我国网络空间的良性循环。 关键词：网络直播平台；政府监管；回应性监管 Abstrat In 2016, my country ushered in the first year of webcasting. The number of webcasting platforms has increased sharply. The webcasting industry has blowout development. With the outbreak of the new crown epidemic in 2022, my country has ushered in a new era of national live broadcasts. However, with the rapid development of the webcast industry, various webcast chaos have also emerged. The government, as an important supervisory body of the webcast platform, plays a leading role in all aspects of supervision. In the current supervision process of webcasting platforms, although government regulatory agencies have achieved certain results in cracking down on illegal phenomena and rectifying the live broadcast industry, there are obvious shortcomings and deficiencies in the construction of laws and regulations, supervision mechanisms, and supervision methods. By summarizing and analyzing the various problems of the government’s supervision of live webcasting platforms, and on the basis of drawing on foreign advanced experience, the author proposes to continuously improve the construction of our country’s legal system, strengthen the implementation of main responsibilities, innovate supervision methods, and form a government, enterprise, The social joint supervision system and other suggestions have realized the virtuous circle of my countrys cyberspace.
