集 美 大 学 JIMEI UNIVERSITY 毕 业 论 文 题目　交通肇事逃逸行为独立犯罪化问题研究 交通肇事逃逸行为独立犯罪化问题研究 ［摘要］ 随着人类文明的不断发展，日新月异的交通运输业为我国的现代化建设起到了积极的推动作用，但也带来了一些问题。交通事故的频发，严重威胁着国民经济的健康发展，特别是行为人的在交通肇事后的逃逸行为，不仅使事故责任的认定产生了很大的困难，对人民的生命财产安全更是造成了不可挽回的损失。但是，我国的法律以及司法解释只是将逃逸行为作为交通肇事罪的加重情节，这明显不利于对交通肇事逃逸行为抑制。再者，逃逸行为相对于交通肇事罪来说具有更为严重的社会危害，具有独立行为价值，具备单独设立罪名的条件。因此，我国刑法应当借鉴外国先进的立法技术，实现逃逸行为的独立犯罪化。 ［关键字］ 逃逸　犯罪独立化 交通肇事逃逸罪 Escape Behavior Research of Independent Crime of Traffic Accident Abstract With the continuous development of human civilization, the rapid development of the transportation industry has played a positive role in promoting the modernization of our country, but it also brings some problems. Traffic accidents occur frequently, a serious threat to the healthy development of the national economy, especially the behavior in the traffic accident escape behavior, not only make the cognizance of responsibility for the accident caused great difficulties, to peoples life and property safety is caused irreparable damage. However, our countrys legal and judicial interpretation is just the escape behavior as the aggravating circumstances of the crime of traffic accident, which obviously is not conducive to the traffic hit and run behavior inhibition. Moreover, the escape behavior has more serious social harm than the crime of causing traffic casualties, has the independent behavior value, has the condition to establish the charge separately. Therefore, the criminal law of our country should draw lessons from foreign advanced legislation technology, realize the independent crime of escape behavior.
