 PAGE \* MERGEFORMAT 30 论民事保护令在反家暴法中的适用 摘 要 民事保护令在我国主要体现为人身安全保护令，虽然我国在反家暴法中对人身安全保护令进行了专章规定，体现了立法的进步，但民事保护令在我国反家暴法中的适用也存在着申请主体的范围过于宽泛且义务不明确、民事保护令的范围比较狭窄、申请民事保护令的审理程序不健全等问题。本文主要通过对民事保护令制度的基本法律理论、其他国家和地区关于反家暴法中民事保护令制度的相关规定以及完善我国反家暴法中民事保护令制度的措施三个部分的探讨，介绍了民事保护令制度在我国反家暴法中的具体适用情况。在借鉴域外民事保护令的成功经验的基础上,结合我国目前立法现状与司法实践，尝试着为我国反家暴法中的民事保护令制度提出一些完善方案,以期加快我国家庭暴力防治的法制化进程。 关键词：民事保护令，人身安全保护令，家庭暴力，受害人 On Application of civil protection order in the law of against domestic violence ABSTRACT Civil protection order in our country mainly to protect the personal safety of the order, although our country in the anti domestic violence law to protect the personal safety of the order of the provisions of chapter, reflecting the progress of legislation, but civil protection make in Chinese anti domestic violence law applicable also exist in the scope of application of the main in broad and obligations are not clear, narrow the scope of civil protection order, civil protection order of trial procedure is not perfect and so on the question. In reference to the basis of the successful experience of foreign civil protection order, combined with the legislative situation and judicial practice of our country, try for Chinese anti domestic violence law of civil protection order system put forward some solutions, in order to speed up the process of Chinese domestic violence prevention.
