It is very important to determination of excessive defense and deserved punishment to the defender and finally to fit the principle of suiting punishment to crime and criminal responsibility. At present, domestic and foreign criminal laws about the sin forms of excessive defense, regardless of the theories of criminal law and judicial practice, there are great disputes; majority theories consider that the sin forms of excessive defense may be indirect intention and negligence (including careless and inadvertent negligence and negligence with undue assumption), but couldn’t include direct intention. In this paper, first I discuss on the implication and nature of the sin forms of excessive defense, and then I analyze the direct intention and the purpose of defense, discourse upon my opinion of the sin forms of excessive defense in light of the theories of the sin forms of excessive defense at home and abroad and judicial practice. Finally I come to a conclusion: The sin forms of excessive defense, except indirect intention and negligence (including careless and inadvertent negligence and negligence with undue assumption), may be direct intention in the case of continuous illegal prejudice and some “pattern of victim’s temptation”, but couldn’t be fortuitous event.
