In Section Three,this article expatiates the main content and traits of our country’s system of judgemente by default.It analyzes the flaws in many aspects,such as the relation between judgement by default and some basic principles in civil procedure,trial proceedings by default and remedy after default judgement. This article,in the last section,discusses how to reform and perfect the system of judgement by default in China.According to the review and analyse over the regulations of external system of judgement and the legislative and judical practice in our country,the author brings forward several suggestions,namely, coequally treat the plaintiff and the defendant when they default,endow parties with rights to choose procedure,establish authentication mode under Verhandlungmaxine,design judgement by default in pretrail procedure,found rational trial procedure,as well as set up demurral system as a remedy after judgement by default.
