影响中国著作权法的因素： 两级博弈论  摘 要 本论文力求进一步获悉建立和修改中国知识产权法，尤 其是著作权法的背后原因。为了完成这项任务，本文借鉴了 Robert Putnam 的 “双层博弈”理论。本文探讨了中国在知 识产权方面的国际谈判，其中发现4个阶段：1）初始利益； 2）接纳；3）和解；4）恢复利益。本文用 Putnam的理论框 架来分析这一论述。 中国的知识产权立法机关是受国际因素和国内因素的 综合影响，但是近些年来，国内因素日益重要的影响着中国 知识产权法和法律的执行。 本文阐述了复杂的国际国内因素对中国著作权法形成 的方式，因此为政治学习领域提供了创新。除了前面提到的 Robert Putnam “双层博弈”理论的案例分析，此研究的实 际可适用性是其调查结果可以阐述知识产权立法进程怎样 在一个转型经济区发生，进一步洞悉不同的影响因素是如何 塑造和界定著作权法的。 关键词: 知识产权，中国，著作权，国际关系，双层博弈。 i Influencing Factors on China’s Copyright Law   ABSTRACT This paper strives to understand the reasons behind the creation and modification of China’s intellectual property rights law, specifically the Copyright Law. To achieve this task, it draws upon Robert Putnam’s “Two Level Game” theory. The article provides an account of China’s international negotiations related to intellectual property, where four stages are identified: 1) initial interest; 2) acceptance; 3) compromise; and 4) revival of interest. Putnam’s theoretical framework is used to analyze China’s international negotiations related to intellectual property. A combination of international and domestic factors have influenced China’s intellectual property legislature. In recent years, domestic factors have become increasingly influential in shaping China’s intellectual property rights laws and enforcement.
