论网络犯罪及其刑法规制 摘 要 随着计算机信息技术、网络的迅猛发展，人类进入了互联网时代，网络的飞速发展给人类社会带来了巨大的进步和无穷的利益。但是，网络技术也是一把双刃剑，一些不法分子看准了这一点，利用网络频频作案，网络犯罪不断增长。网络领域的违法犯罪现象也已成为现代社会难以拒绝的“不速之客”。 如今，传播计算机病毒、剽窃资料库机密、网上恐怖活动、网上盗窃、传播色情等日益猖蹶，鉴于计算机网络犯罪已经严重威胁因特网的生存与发展，对网络犯罪的规制、打击和预防已成为现代社会、国家和政府的重大课题。要有效地防治网络犯罪，在预防方面，必须坚持以预防为主，打防结合，标本兼治的综合防范体系；在社会对策方面，既要加强“三位一体”的社会教育，又要加强网络自身的管理和安全；在刑事对策方面，既要加强刑事立法方面的建设，又要加强刑事司法方面的建设。 有鉴于此，本文着力对网络犯罪的概念、特征、现状、危害等方面从刑法规 制的角度进行了初步的分析与探讨，并提出一些防范措施，进而更好地对网络犯罪进行预防和规制。 关键词：网络犯罪，犯罪预防，刑法规制 The Network Crime And Criminal Law ABSTRACT Along with the computer information technology, rapid development of Internet, the human race has entered the era of Internet, the rapid development of network to human society brings great progress and infinite interest.
