浅析工伤事故损害赔偿制度 摘 要 我国虽然对侵权行为引发的工伤赔偿问题进行了立法规定，但法条间还是存在着明显的矛盾，各地方立法规定差异明显，司法不统一，这迫切需要理论界进行深入研究，如何完善法律对处理工伤保险补偿与民事侵权赔偿竞合时的法律适用，即为本文拟探讨的内容。文章首先从工伤事故损害赔偿制度缘起，工伤事故损害的民事侵权赔偿和工伤保险补偿制度比较出发，并通过分析工伤保险补偿与民事侵权赔偿的竞合关系，阐述工伤保险补偿与民事侵权赔偿竞合的原因和表现形式。然后，对世界主要国家关于工伤保险补偿与民事侵权赔偿竞合立法模式的介绍，提出对我国的启示，并指出我国现行立法现状，最后，提出完善建议，适用工伤保险补偿优先、民事侵权损害赔偿为补充的模式，以期进一步加强和完善对劳动者合法权益的充分保护达到应有的对各种利益的平衡，维护社会秩序的和谐稳定。 关键词：工伤保险补偿 民事侵权赔偿 责任竞合 Inductrial injury insurance compensation and the theory of civil tort compensation Abstract Although the cause of tort compensation inductrial injury problems, but the law legislation still exist between apparent contradiction, the local legislation, judicial no significant difference, the urgent need further study and theoretical how perfect law of inductrial injury insurance compensation and civil tort compensation during the competition, the applicable law is discussed in this paper. Then, in the main countries about inductrial injury insurance compensation and civil tort compensation competition, the legislative model is introduced to China, and pointed out the revelation in current legislation, finally, the improving Suggestions, inductrial injury insurance is applicable civil tort compensation for damages, the model, in order to further complement to strengthen and improve the fully protect the legitimate rights and interests of labourers to attain the balance of various kinds of interests, to safeguard the social order of harmony and stability.
