摘要近年来，我国医患双方纠纷愈来愈多，医生和患者的矛盾越来越激烈已经成 为普遍事实，双方争议的焦点即患者的权力是否得到了尊重，在众多忽视患者权 利的行为当中，过度医疗行为最为凸显。究其原因，医疗体制固然存在缺陷，然 而医学界与法学界对患者权利欠缺制度层面的系统思考和规制也是不容忽视的， 在我国目前的医疗机构中大部分医护人员虽然学历提高，但对患者应该享有的权 利以及医疗过程中如何充分尊重患者权利缺乏认识。法学界，只有极少数的具有 医学背景的人对此问题进行了研究，除此之外的学者相关研究少之又少。鉴于此 种境况，加大对医疗主体过度医疗行为的研究是非常有必要的。本文就着重从医 疗主体中广泛存在的过度医疗行为入手，着眼我国侵权责任法的规定，从多角度 就过度医疗行为进行阐述和分析，以期能对我国政府制定相应政策具有重要的参 考价值。本文除了引言和结语外，主要由四部分组成。第一部分是过度医疗行为概述， 主要是介绍过度医疗行为的概念、特征、性质，并从多个方面就过度医疗行为成 因及类型化进行了阐述。第二部分结合我国侵权责任的认定，就过度医疗行为责 任基础及过度医疗侵权责任构成、归责和赔偿深入进行分析。第三部分着重介绍 了我国《侵权责任法》的针对过度医疗行为的立法规定及缺陷。第四部分则是过 度医疗行为完善及救济途径，力求为缓解我国当前因过度医疗行为导致的尖锐医 患纠纷提供一些有效地措施。关键词：医疗主体；过度医疗行为；侵权责任法；过度检查；AbstractIn recent years, the number of patient disputes rose sharply, the doctor-patient conflicts has become an indisputable fact , and the contradiction of the core issues focused on the rights of the patients who failed to received due respect, many acts which ignore patients rights.The behavior of excessive medical is the most prominent The health care system is certainly flawed systems thinking and regulation of patients rights and the lack of institutional level, however, the medical profession and the legal community can not be ignored, practicing medical staff, despite some substantial increase academic qualifications, but patients what rights, as well as a unified and a clear understanding of how the right to respect for and protection of patients in the medical event.
