从美国的残疾人教育法看美国对残疾人权利的保护 姓名：罗敏丽 院系班级：法学院1204班 学号：2012101190 从美国的残疾人教育法看美国对残疾人权利的保护 【摘要】 教育公平是社会公平的表现，教育公平的基础应该是人的平等，社会对人的基本权利的尊重，对所有儿童受教育权利的尊重和保护，所有儿童包括任何民族和种族，任何地域，任何家庭背景，任何身体状况等等的所有儿童。美国的宪法是基于《人权宣言》而制定的，而以宪法为基础，美国的《残疾人教育法案》也体现了以人为本，保护个人的权利，尤其是受教育的对象方面，注重对所有儿童的受教育的权利保障。从美国的案例出发，探求作为案例的法律基础《残疾人教育法案》所体现的宪法精神及其价值。 【关键词】 残疾人教育法 美国宪法 残疾人权利 人权 the Protection of the disabled people’s right in America [Abstract] The educational equality,which should be based on the equality among people,is the performance of social equality.The society should show respect to human beings，all human beings,for their basic rights.Here,all human beings include people of any nation,any place,any family background,any situation and so on as long as he is living in the society.The American Constitution is bases on Declaration of the Rights of Man and of the Citizen.And based on the American Constitution,the Individuals with Disabilities Education Act takes people as the foremost,protects the individual rights,especially the one who needs education and the group of disabled children’s educational rights protection.In view of American cases,the paper is going to talk about the rights protection of the disabled is how to be set up in America from the legal protection for the disabled children’s education.To make it further,the paper is also going to search the constitutional spirit and value which is shown in the Individuals with Disabilities Education Act.
