带薪年休假制度虚置现象之探讨 随着社会经济的发展,休假在人们生活中的地位越来越重要,带薪休假是对人休假权利的一种尊重,也是社会文明进步的一种标志。随着我国企业的国际化运作和旅游经济的兴起带薪年休假制度已日益受到人们的关注。虽然法律早已明确规定职工享有带薪年休假,但是在现实中执行的并不理想。带薪年休假制度的实施依然是困难重重这既包括管理者轻视、被管理者忽视、总体观念上不重视;也包括配套的法律法规不健全、制度不完善、系统整体上不协调及执行力不强带来的问题,还包括因利益问题而形成的人为抗拒等原因。为了保障带薪年休假制度的实施,特别要从观念上提高认识,把带薪年休假制度普及为一种共识,将带薪年休假制度完善为一套体系,使带薪年休假制度演变为一项措施等三个方面的策略来加以应对。同时还借鉴了国外带薪年休假制度及相关配套政策在舆论监督和执行等方面加强措施以使带薪年休假制度更加完善。 关键词: 休假 带薪年休假 障碍 保障 实施 On phenomenon of paid annual leave Abstract With the development of society and economy, Annual paid leave in peoples lives plays an more and more important role, Which is a respect to the people’s vacation rights, as well as a sign of social civilization progress. As internationalization of the enterprise operation and the rising of the tourist economy, annual paid leave system has been increasingly concerned. Although the law clearly defined that workers are entitled to annual paid leave, in reality the laws’ implementation is not satisfactory. The implementation of the annual paid leave system is still difficult, not only included ignoring or overlooked by managers, de-emphasis in whole concept, but also incarnated on the imperfect of related laws and regulations , imperfect system, lack of coordination in the system overall and implementation of the force is not strong. In order to protect carrying out of the Annual paid leave, we should enhance cognition from the concept of paid leave, and make it become a common view and perfect system. Meanwhile, the article also use the abroad annual paid leave law and relevant supporting policies for reference, and also bring forward how to enhance measures of supervision and implementation, in order to make the system of annual paid leave more perfect.
