摘 要 明确规定不动产登记机关的赔偿责任,是完善我国不动产登记制度的重要 内容和目标。不动产登记机关对登记错误承担赔偿责任,既是登记公信力理论 的合理逻辑延伸,也是其权责相统一的必然要求。从登记功能上以及民事权利 救济途径上考虑,不动产私权保护的登记制度与作为课税权行使基础的登记制 度大为有别,登记制度的不完备、欠缺或者登记薄的记载内容不完全等所带来 的不利益,最终结果仍得由私人承受,故不动产登记行为在性质上应为民事行 为,不动产登记错误应属民事侵权行为,应通过民事诉讼予以更正和补救。登 记机关的赔偿责任应适用侵权责任中的严格责任原则进行归责,并应具备侵害 行为、损害后果以及因果关系三个构成要件。针对我国不动产登记责任机制所 存在的登记机关不统一、登记职员素质落后、没有建立明确的登记责任追究和 赔偿制度,并因而造成登记质量不高、登记的公信力低下等问题,将来的相关 立法应从统一登记机关、对不动产登记机构实行严格的职业资质准入及职级升 降考核机制、建立登记责任追究机制等方面加以完善。 关键词:不动产登记;登记机关;登记行为;实质审查;赔偿责任 I ABSTRACT Real estate registration office clearly defined liability, it is necessary to improve Chinas real estate registration system for the important content and objectives.
