The Americans With Disabilities Act The Americans With Disabilities Act (“ADA”) provides that an employer shall not discriminate against a qualified individual with a disability. 29 U.S.C. § 12112(a). A qualified individual with a disability is defined as an individual with a disability who, with or without reasonable accommodation, can perform the essential functions of the employment position that such individual holds or desires. 29 U.S.C. § 12111(8). The regulations describe the term reasonable accommodation as any change in the work environment or in the way things are customarily done that enables an individual with a disability to enjoy equal employment opportunities. 29 C.F.R. pt. 1630, App. 1630.2(o). The ADA itself provides that reasonable accommodations include the following: job restructuring part-time or modified work schedules reassignment to a vacant position acquisition or modification of equipment or devices appropriate adjustment or modifications of examinations training materials or policies the provision of qualified readers or interpreters 42 U.S.C. § 12111(9). An employer who fails to provide a reasonable accommodation when necessary will be liable for discrimination under the ADA unless the employer can demonstrate that the accommodation would impose an undue hardship on the employers business. 42 U.S.C. § 12112(5)(A). When considering whether a proposed accommodation would impose an undue hardship, the following factors should be considered: the nature and cost of the accommodation needed; the overall financial resources of the facility or facilities involved in the provision of the reasonable accommodation; the n
