第三部分主要介绍了许诺销售侵权的归责原则以及救济。笔者主要根据许诺销 售侵权与专利侵权的不同来概述其归责原则，并表达了笔者的观点。许诺销售侵权 的救济主要包括三个方面：实体救济、程序救济和行政救济。 第四部分主要讲述了对许诺销售侵权损害的赔偿。该部分首先对许诺销售侵权 损害赔偿的原则进行了全面的概述。然后对侵权损害赔偿范围的两个方面做了较为 详细的阐述，以使得受害人更好的获得应有的救济。最后，笔者发表了自己的观点， 对许诺销售侵权的损害赔偿提出了合理化的建议。 最后一部分，对该文进行了总结。 关键词：许诺销售权；专利权； 即发侵权 ；损害赔偿 II Abstract With the development of econnmy,technology and political,the types of intellectual property also become increasingly rich.on the one hand,by enacting new law,new type of intellectual property is added; on the other hand, new options are provided by adjusting the present legal framwork,china’s present patent law-the People’s Republic Patent Law was amended in August 25,2000 by the ninth session of the National Peopie’s Congress stanging committee 17th meeting. It is the second amendent of this law and would be offcially implemented form july 1,2001. The revision is in line with the rapid deveploment of modern technonlogy and the needs of the world trade organization,strengthening the protection degree of patent right and scope. Through this revision, offer to sellcomes into our field of vision.Then ,the third modification of patent law in 2008 ,increased the offer to sell rights of apperance design,making our protechtion of this right more advanced and comprehensive. Offer to sell is to priovide sales or for sales ,in short ,made it clear that the behavior or the meaning will to sell a product. Offering to sell would be constitute infringement ,but the infrigement of offering for sale is diffirent from other ingfrienment, this stage of the pantentee does not exist in actual damage,inCivil Lawdoes not promise offering for sale as the special infringement .othervise ,how to drfine the offering to sell?
