著作权论文：著作权 网络环境 合理使用 【中文摘要】温家宝总理曾这样形容知识产权在国家整体发展中的地位,他指出：“世界未来的竞争就是知识产权的竞争”。著作权的合理使用制度作为著作权法中划分著作权人专有权的止境与社会公众获取作品自由的起点的界限,是著作权法领域的“斯芬克斯之谜”,随着网络技术的纵深层次的不断发展,传统的著作权合理使用制度面临着前所未有的困境和挑战,如利益平衡机制受到质疑,公益和私益面临冲突,合理使用的判断标准和使用范围受到冲击等。因此,建构和完善网络著作权合理使用制度也成为应对这种挑战和走出这种困境的必然趋势,而且这种建构和完善对于规范在网络环境下知识产权的竞争也显得尤为迫切。所以,对网络环境下的以网络信息传播权为代表的网络著作权的合理使用制度作出研究,指出现状问题并加以完善,对于我国著作权合理使用制度的修改具有重大的理论价值和现实意义。笔者本文首先以网络著作权合理使用制度面临的新问题为着力点,着重介绍了网络环境对传统著作权合理使用制度的影响和冲击。接着从传统著作权合理使用制度的基本理论入手,重点阐述了著作权合理使用制度的理论基础和一般规定。然后以探讨网络著作权合理使用制度面临的功能障碍和存在价值为核心,从理论和实践层面对网络著作权合理使用制度作具体的分析,包括现存问题及域外经验等。最后,以构建和完善我国网络著作权合理使用制度为,完善著作权合理使用制度、明确界定合理使用情形、合理构建网络合理使用的判断标准、引入法定许可制、实行推定许可制等几个方面提出了构建和完善我国网络著作权的合理使用制度的具体对策。 【英文摘要】Premier Wen Jiabao once described the overall development of intellectual property in the State’s position, he said:”The world’s future competition is the competition of intellectual property rights”. The fair use system in the copyright law is “Sphinx” in the field of copyright law, because it is regarded as a compass dividing the terminal of the copyright owners’right and the starting—oint of the exclusive right of public access to works. As the deep-level network technology continues to develop, the traditional system of copyright fair use is facing unprecedented difficulties and challenges, such as the balance of interests is challenged, faced with public and private interest conflict. And the criteria for determining fair use and the use of the range is under attack. Therefore, the construction and improvement of the network has become the copyright fair use out of response to this challenge and the inevitable trend of this dilemma. And this construction and improvement of the environment for the norms of intellectual property rights in the network competition is particularly urgent. Therefore, we should make a research of fair use system in the copyright law, which is represented by the right of network information dissemination. And we also should study the situation and problems of rational use o
