内容摘要 行政自由裁量权是现代行政权的核心，是真正和实质性的行政权力，对它施 加必要的控制是必需的。而行政案卷制度作为一种行政程序制度，以其公开性、 真实性、封闭性和排他性等特征和公开、效率和控权原则成为控制行政自由裁量 权的有效武器。本文从理论和现实层面探讨了行政案卷制度对行政自由裁量权的 控制。本文分为四个部分： 第一部分对行政自由裁量权与行政案卷制度的概念进行清晰的界定，主要论 述了行政自由裁量权的产生、含义及特点，行政案卷制度的起源、内涵及特征。 第二部分主要对我国行政自由裁量权及其控制的现状进行分析。文章分析了 行政自由裁量权存在的社会基础、我国行政自由裁量权滥用的具体表现及造成行 政自由裁量权滥用的原因。 第三部分从理论和现实层面分析行政案卷制度能够实现对行政自由裁量权的 控制。文章从四个方面分析了行政案卷制度控制行政自由裁量权的必要性，从行 政案卷制度自身的价值、现实基础、比较法基础等方面分析了行政案卷制度控制 行政自由裁量权的可行性。 第四部分主要探讨完善我国行政案卷制度控制自由裁量权的对策建议。这是 论文的重点和难点。首先建议完善相关立法，其次建议进一步完善行政案卷制度， 第三明确违反行政案卷制度的法律责任。 关键词：行政案卷制度  自由裁量权  控制 I Abstract The administrative discretion is the core of administrative power and is necessary to be controlled.
