华 中 科 技 大 学 硕 士 学 位 论 文 摘  要 以人格权与财产权二分法为基础构建民事权利体系是近现代民法的基本特征， 文章先从考察人格权概念的历史由来出发，发现人格权在新的历史条件下主体扩张 和客体复杂化的事实，并剖析传统民事权利体系中财产与人格二分法的局限性，接 着具体分析人格权中各种形式的财产利益：自身不具有财产因素但与财产利益相关 联的人格权包括物质性人格权和部分自由型人格权、尊严型人格权；具有间接财产 利益的人格权如姓名权、肖像权等标表型人格权和隐私权；具有直接财产利益的人 格权如名称权、信用权。在此基础上提出了几类人格权中财产利益的保护方式：以 财产损害赔偿为主、精神损害赔偿的附随性保护、明确人格权中的财产利益的移转 和继承制度、确立商品化权并以知识产权保护作为基本手段以及其它有关财产利益 的保护途径。最后指出我们需要重新反思民事权利体系中的人格权与财产权二分法 的局限性，清楚认识并梳理人格权中所蕴藏的各种类型的财产利益，包括直接财产 利益和间接财产利益以及与人格权具有某种关联程度的财产利益，运用现有的关于 人格权的保护制度并积极探索新的权利保护机制，全方位多途径地给予人格权中的 财产利益提供有效的保护，进一步提高人格权的保护层次并完善民事权利体系。 关键词：人格权; 财产利益; 商品化权; 民事权利 I 华 中 科 技 大 学 硕 士 学 位 论 文 Abstract Personality rights and property rights dichotomy - based civil rights system is the basic feature of modern and contemporary Civil Law. The article first retrospects the historical origin of the concept of personality rights, finding the facts of the expansion of civil subjects and the complication of civil objects under the new historical conditions. Then, the limitations of personality and property dichotomy in traditional civil rights system are dissected. Next, it follows that various forms of property interests associated with personality rights are analyzed in detail: personality rights ,including materiality personality rights and some of free-type spirit personality rights and dignity-type personality rights, do not have the property factors themselves but relate to property interests; personal name right, portrait right and privacy right are indirectly related to property interests, and such personality rights as organizational name right and credit right have direct connection with property interests. On the basis of the above, several ways to protect the property interests connected with personality rights are put forward: first, mainly compensate for property interests loss with that for mental hurt supplementary.
