摘要

在我国《刑法修正案（十一）》对刑事责任年龄进行下调的背景下，本文对国内刑事责任年龄下调问题的争议和三种学术观点进行了介绍，对我国刑事责任年龄的历史发展脉络进行了简单梳理，通过文献研究法提出我国当前刑事责任年龄制度存在的未成年人刑事责任年龄的部分法律规定不明确、十二到十四岁纳入管辖的犯罪范围过窄、未成年人专门教育制度的适用条件不够明确等问题并进行探究，并提出拓展未成年人相对刑事责任年龄段的罪名适用范围、引入恶意补足年龄制度、明确未成年人专门教育制度的适用条件等具有可操作性的建议，以遏制目前社会上低龄未成年人实施恶性案件的趋势、保护受害者。

Abstract

InthebackgroundoftheloweringoftheageofcriminalresponsibilityintheCriminalLawAmendment(XI)ofourcountry,thispaperintroducesthecontroversyandthreekindsofacademicviewpointsontheloweringoftheageofcriminalresponsibilityinourcountry,thehistoricaldevelopmentoftheageofcriminalresponsibilityinourcountryissimplysortedout,throughtheliteratureresearchmethod,thispaperputsforwardandprobesintosomeproblemsexistinginthecurrentagesystemofcriminalresponsibilityofminorsinourcountry,suchastheunclearlegalprovisionsontheageofcriminalresponsibilityofminors,thenarrowscopeofcrimesunderthejurisdictionof12to14yearsold,andtheunclearapplicableconditionsofthespecialeducationsystemforminors,andputforwardOperabilityproposalssuchasexpandingthescopeofapplicationoftheagegroupfortherelativecriminalresponsibilityofminors,introducingasystemofmaliciouslysupplementingtheagegroup,andclarifyingtheconditionsfortheapplicationofthespecialeducationsystemforminors,inordertocurbthecurrentsocialtrendofyoungminorstocarryoutmalignantcases,toprotectthevictims.
