论实用艺术作品的法律保护 论实用艺术作品的法律保护 V《53255 提 要 本文写作目的在于强调实用艺术作品作为著作权保护客体的地位， 希望引起立法者和实用艺术作品著作权人的关注，从而进一步推动日 益繁荣的实用艺术作品的创作事业。文章从三个部分对实用艺术作品 的法律尤其是著作权法保护进行了论述：即实用艺术作品是艺术性与 实用性相结合的作品；实用艺术作品的法律保护探讨；对于实用艺术 作品保护的几点设想。在第一部分当中，主要针对实用艺术作品的概 念、特征、范围进行了阐述，并明确了实用艺术作品保护的必要性和 它所包含的内容。第二部分从比较法学的角度列举了国际条约以及其 他国家关于保护实用艺术作品的规定。同时分析了由于实用艺术作品 的特殊性使得对于它的保护涉及到知识产权内部各权利之间的联系 和冲突，并进一步分析了冲突产生的原因和解决的原则。第三部分作 者提出了对实用艺术作品保护的几点设想，并明确指出应将实用艺术 作品作为保护客体列入我国著作权法当中。同时对于产生于实用艺术 作品上的在后权利的处理办法、建立美术作品(包括实用艺术作品) 著作权集体管理组织以及实用艺术作品的堡拯丛枣和赔偿问题进行 了详尽的分析和论述，并提出了自己的观点。 关键词：实用艺术作品著作权保护实用魁—毹体管理组织 Discuss Discuss on The Legal Protection of Appliance Arts ”白rks Author：zou xin Supervisor：Li Xinxin ABSTRACT The legal protection especially in the law of copyright of appliance art works is studied in this thesis based on the discussion of the following three parts，i．e the characters of the appliance art works(Practicability and artistry are the characters of the appliance art works and these two characters Can not be divided．)；the legal protection of appliance art works and several suggestions and concehs on the legal protection of appliance art works．In the first part，the concept and characters as well as the scope of appliance art works are discussed．It is defmitely pointed out that the appliance art works should de protected by law．In the second part，compared with International Pacts such asBern Pact．TRIPSand the regulations of other Countries for example England and France，it is pointed out that some regulations Can be used for reference．On the other side，the conflicts among the property rights are inevitable because of the dual characters of the appliance art works．Furthermore，the reasons of conflicts and the methods to resolving the conflicts ale also discussed in this part．In the last part，several suggestions and conceits are brought forward．It is definitely pointed out that the appliance art works should be listed In the Copyright Law as object，meanwhile the methods of resolving posterior rights on the appliance art w
