房屋征收公开、参与制度研究 房屋征收公开、参与制度研究  概  要  房屋拆迁作为涉及城市房屋这一重大非国有财产的征收事项，关 系广大城市居民基本生存、生活条件。然而，当前房屋拆迁公开、参 与的现状是明显令人担忧。究其原因主要是城市房屋拆迁的决定权、 补偿权、执行权仍然主要由政府独揽，被拆迁人对城市建设、房屋拆 迁的知情权、参与权远远没有得到合理的保护。政府（行政机关）和 被拆迁人作为房屋征收的两方面主体，不仅需要制度上的平等，更需 要实际上的平等，而这种平等权，必须通过对权利的保护——公众参 与，及对权力的制约——政府（行政机关）公开两方面来实现。为保 障被征收人的合法权益，建立基于《物权法》基础上的房屋征收公开、 参与制度具有十分重要的意义。政府（行政机关）主要通过保障被征 收人的知情权和参与权逐渐从被动公开转向主动公开，民众方面则通 过建立完善房屋征收前听证制度、补偿安置方案征询制度和搬迁前的 听证制度从限制参与转向充分参与，同时，引入人大代表、政协委员、 社区工作者、法律界人士等独立第三方参与房屋拆迁的监督，使他们 从有限参与转向全方位参与。 关键词 物权法，房屋征收，公共利益，知情权，参与权 2 房屋征收公开、参与制度研究 Public, participation system of house collection research ABSTRACT Demolishment and reconstruction of urban houses as a major issue of collecting non-state owned property, concerns the basic survival and living conditions of the urban residents. However, the status quo of the release of housing demolition and resident’s participation is obviously disconcerting. The mainly reason is that the decision, compensation, and execution powers of the demolishment and reconstruction of the urban houses remains with the government, and the rights of the owner of the removed houses to know and participate in the urban construction and house demolition and relocation are short of guarantee. As two parts of the house collecting, the government (administrative authorities) and the owners not only needs to be equal in rules but also in fact. The equality must be guaranteed not only by public participation which is the protection of rights but only by the release of such issues which is the constraint of power. In order to protect the legitimate rights and interests, the system to make house collection public and residents participate should be established based on Property Law. The government (administrative authorities) gradually shifts from passive to active open on this issue by guaranteeing legitimate rights to know and participate.
