AbstractThecrimeoffraudclassifiedasonekindofcrimeofenroachmentupon propertyistheprevelentcrimeallthetimeinthecriminaljudhicialfield.As theproductionofthedevelopmentofoursocialist market economy, the crimeofcontractfraudgetoutofthecrimeoffraudandbeconvicted independently.Butthecontractfraudisafterallatypeoffraudcrime,so thereexistsmanysimilaritiesbetweenthecrimesoffraudandcontractfraud coupledwiththediversity,complexityandimperceptibilityofthemeansof contractfraud.Sotheboundarybetweenthecrimesof contract fraud and fraudhasbecomeabigproblem.Theauthorthinksthattheboundaryofthe contractfraudandfraudbearsimportantpracticalsignificanceforthiskindof case.Throughoutthispaper,itanalyzesthecontroversialfocusofapractical caseincombinationwiththeresearchresultsofthetheorycircleinorderto analyzeandresearchtheboundaryproblemofcontractfraudandfraud.Thefirstpartofthethesisstatementofthe case facts, and find five focusofdispute.Thesecondpartistheconcreteanalysisofthecase,thatis, incasethedefendantonepartoftherentandhiddenflightthatbehaviorand thepurposeofillegalpossession,andtoanalyzeChensignedwithacompany isatowercranetoentrustthenatureoftheescrowagreement.Finallyalso analyzesthedifferencebetweenthecrimeoffraudandcontractfraud,andthe defendantChenaconstitutethecrimeoffraudorthecrimeoffraudofthe contract.Thethirdpartiscasestudy.Throughcaseanalysissummarizesthe boundariesbetweenthetwocrimes,forthecasesoftheclasshavecertain practicalsignificance.Keywords:ThecrimeofcontractfraudThecrimeoffraudTheboundary ThepurposeofillegalpossessionThecontract目录绪论..................................................................................................1一、选题的背景和意义.......................................................................1二、研究现状......................................................................................1三、研究方法......................................................................................2一案情介绍及争议焦点.....................................................................
