Administrativecontractistheproductofthechangesoffunctionandstructureinadministrativelaw.Itistheorganiccombinationofpowerfactorandcontractualfactor,Onlythetwofactorsachieveacertainbalance,cansymbiosisberealizedinadministrativecontract,coincidingthesubstanceofadministrativecontractandmakingadministrativecontractplayitsproperfunction.Inordertoensurethedynamicequilibriumofthetwofactors,thetwovariablesmustbecontrolledwithinacertainrange,cannotbebiased.Powerfactormainlymeansthatadministrativecontractaimstopublicinterestandadministrativepurpose,manifestingconcretelythenecessityanduseofthecontractualprivilegesofadministrativeorgan;contractualfactorshowstheadmissionoftheexpressionofprivateinterestandthepursuitoffreewill.Inviewofthepriorityofpublicinterestandadministration,contractualfactorcanonlyexistinthelimitedspace,expressedasthecontractualconsensusofbothsidesofadministrativecontract.Thelimitofexistingspacecanbecompletedbyimprovingthequalityofconsensus,toincreasetheproportionofthecontractualfactorcomparingtothepowerfactorandtoachievethebalanceofthetwofactors.Thetheoryofcommunicativeactionprovidesadiscussingsituationandtheideaofachievingconsensusbyintersubjectivecommunicativerationalityforhighqualityofconsensus.Thedelineationandbalanceofthespaceof power factorand contractual factorcan beimplemented fromthelevelof thespecificsystembyconfiguratingrightsandobligationsoftheadministrativecontract:Recognizethelimitedprivilegesoftheadministrativeorganaccordingtopublicinterestandadministrativepurpose,todesignatethescopeofpowerfactor;createcounterparty’sParticipatingRightstooutlinetheoutlineoftheexistenceofthecontractualfactor.Itmeansimprovingthequalityofconsensusthroughtheexertionofparticipatingrightsandfullself-expressionbythecounterparty.Toachievethisconfigurationoftherightsandobligations,weneedindependentproceduretoguaranteetheconsensusonthebasisofequaldialogueandfullexpression,andnormsofinstitutionalizedprocedurestocontroltheexerciseofcontractualprivileges,forprovidethecounter
