PAGE PAGE 5 劳动关系比较研究 法学专业学生 易凡 指导教师 孙永军 摘要：劳动关系是现代社会最重要的社会经济关系之一，因而，中外学者对其多有著述。本文就是在综合中外劳动关系研究成果基础上，将多种劳动关系及容易与之混淆的社会、经济关系进行对比研究而展开的。文章开头比较论述了劳动关系的概念与特征，接着将正常劳动关系、非正常劳动关系和与劳动关系近似的社会、经济关系进行对比研究，从而完成劳动关系的界定工作；再将典型发达资本主义国家的劳资关系调整模式进行对比研究，籍以寻找对中国特色劳动关系调整模式构建有利的经验；最后，结合我国劳动关系的现实特征和对调整模式的分析，对我国劳动关系调整模式的构建提出了几点建议。 关键词：劳动关系；劳资关系；雇佣关系；事实劳动关系 The Quite Research of Labor Ralations Student majoring in Law YI Fan Tutor SUN Yongjun Abstract：The labor relation is one of modern society most important social economy relation, thus, the Chinese and foreign scholar has the elaboration to it. This article is in synthesizes in the Chinese and foreign labor relation research results foundation, many kinds of labor relations and with it confusions society, the economic relationship carries on the contrast ,seeks for one kind to suit the Chinese national condition the labor relation adjustment pattern, and proposed that the concrete proposal launches. The article opening comparison elaborated the labor relation concept and the characteristic, then normally will work the relations, the unusual labor relations and with the labor relations approximate society, the economic relationships conducts the contrast research, thus completes the labor relation the limits work; The third chapter is carries on the model developed capitalist country labor management relation adjustment pattern the contrast research, the nationality seeks to the Chinese characteristic labor relation adjustment pattern construction advantageous experience; Finally, unifies our country to work the relational realistic characteristic and to adjusts the pattern the analysis, worked the relational adjustment pattern construction to our country to put forward several proposals.
