提 要 劳务派遣此类不同以往的用工手段，主要是从社会主义市场经济水平快速提高基 础之上慢慢出现的，对企业、对劳动者乃至整个社会都有重大的意义。但相对于传统 用工方式而言，劳务派遣还属于新生事物，广大劳动者、用人单位对劳务派遣具体运 作模式还不熟悉；我国现行立法虽然给劳务派遣的开展提供了法律依据，但劳务派遣 的劳动关系划分还很不明确，劳动关系性质还没有统一的定论，各个主体间的权利义 务划分不清，职责不明，从而极大地限制了劳务派遣的正常运行和发展。 本文利用文献分析、比较研究等方法，对劳务派遣及其劳动关系的概念、分类、 劳务派遣存在和发展的必要性和可行性进行了细致分析，通过分析我国劳务派遣劳动 关系的发展现状，总结出当前我国存在着劳动关系性质模糊、主体权利义务不清，劳 务派遣实践操作混乱、被派遣劳动者合法权利得不到有效保障、劳动关系各方利益冲 突明显等问题。对此，可以通过选择正确价值取向、明确劳务派遣劳动关系性质、完 善立法细则、组建行业工会等方式予以解决，最终促进实现劳务派遣良性发展和规范 运行。 关键词：劳务派遣 劳动关系 模式 价值取向 I ABSTRACT Labor dispatching this new type of employing way is to adapt the development of socialist market economy of the product, to enterprise, to workers and the whole society has great significance.
