A b str a c t W ith the rapid developm ent of the Internet technology, the protection of copyright is under severe im pact and challenges. C om pared w ith countless con flicts and disputes of copyright in the netw ork env ironm ent, current copyright law system seem s already backw ard. T his article takes the m echanism of protection of copyright in the netw ork env ironm ent as the object of study. In th is article, w riter analyzed th e theory of balance b etw een the copyright ho lders, the ISP (Intern et S ervice P rov ider) an d the social public, w h ich com es after a brief introduction of a case nam ed H an H an sues B aidu L ibrary infringem ent. D ue to the characteristics of the Intern et, the copyright protection sy stem of our country now faces several difficu lt prob lem s and issu es, w h ich n eed to b e con sidered an d solv ed in the near fu ture. T h e article contain s five parts and heres the brief know ledge of each part :P art I is the introduction . W riter brings out a copyright tort case w h ich has m ade a great flutter in 20 11 and led u s social pub lic, especially law school students to further study. In part II，w riter introduced how the rap id dev elopm ent of Intern et technologies influ ence and attack the trad itional copyright produ ction system . P art III indicated the flaw s and d ifficu lties in copyright protection system , including the conflicts and contradiction s betw een rational use and techn ological protection m easures, the liab ility sy stem of the ISP, the range of territorial jurisdiction in the netw ork env ironm ent, etc. P art IV m ain ly elaborated the new balance of copyright in the netw ork env ironm ent by analyze th e concept and historical developm ent of interest balance in the field of copyright.
