征地补偿制度改革研究 第一章　绪　　论 PAGE 32 PAGE 33 摘 要 目前，我国正处于工业化加速发展的时期，建设用地需求越来越大，而我国集体土地市场暂未完全形成，征收土地是增量建设用地主要来源，因此确定一个合理的征地补偿制度是我国土地管理制度改革的一项重大课题。论文旨在探索建立一个较为科学的合理而且可操作的征地补偿制度。 通过对征地补偿制度变迁进行分析，对目前征地补偿制度作出一个客观公正的评价，找出了目前征地补偿制度的主要缺陷。在对国际征地补偿制度进行介绍的同时，找到了我国征地补偿制度的国际差距。在这些基础之上，创造性地提出适合我国国情征地补偿原则，即使被征地农民的生活水平达到城镇居民的一般生活水平，并在此基础之上设定了征地补偿项目，确定了征地补偿标准，还对征地补偿安置办法和征地程序提出了完善思路。最终，在理论研究和实证分析基础上，重建了我国征地补偿制度。 关键词： 土地征收；征地补偿原则；征地补偿项目；征地补偿程序 ABSTRACT Now，the industrialization of our country develops speedily，and building needs more and more land。But，there have no the market of collectivity land。So， land expropriation is the main source of the increment of building。Then， making a reasonable compensation system of land expropriation is an important task of the reform of our land administration。 This study is aim to discovery a more scientific and reasonable and operated compensation system of land expropriation。 After analyzing compensation system of land expropriation，the paper evaluates it impersonality and equitably，and find out its limitation。When introducing national system of land expropriation，the paper gets out the distance between another country。Basing on these ，the paper comes out the principle of compensation of land expropriation of our country createdly，which is keeping the standard of living of farmers whose land is expropriated reach the town inhabitant’s，and then enacts the item of compensation of land expropriation，makes its standard，furthermore ，gets out how to consummate the means and program of compensation of land expropriation。 Base on the theory study and example analysis，the paper rebuilds compensation system of land expropriation of our country。 Key words: land expropriation； he principle of compensation of land expropriation； the item of compensation of land expropriation； the standard of compensation of land expropriation； the program of compensation of land expropriation 第一章　绪　论 1.1 选题目的和意义 2004年，我国人均GDP已达1050美元，经济发展水平到了工业快速发展时期，建设用地需求越来越大，而我国国有存量建设极为有限，
