论我国经济犯罪资格刑刑种增设-毕业论文.doc

摘  要 经济犯罪是当今世界一个严重的社会问题。随着我国市场经济的不断发展， 在经济领域，也不断产生了一些新型的经济犯罪。我国现有的刑罚体系是一种以 自由刑为中心、广泛适用生命刑的刑罚体系。这种刑罚体系对于惩治经济犯罪有 着明显的不足和缺陷。资格刑是一种针对经济犯罪的有效的刑罚方式，却很少被 运用于惩罚经济犯罪。资格刑与其它三种刑罚方法比较而言，具有宽缓性和温和 性。随着刑罚轻缓化趋势的发展，资格刑必然会受到越来越多的重视，增设经济 犯罪资格刑既是必需的也是亟待解决的问题。本文正是顺应了这种趋势，对经济 犯罪资格刑的设置进行了粗浅的分析论述，希望对我国的经济犯罪资格刑的完善 有所裨益。 笔者认为，资格刑已在世界各国刑事立法中被普遍采用，我国关于经济犯罪 资格刑的立法具有不足之处。在经济犯罪立法中扩大设置资格刑具有必要性和可 行性。笔者在此基础上提出了一些具体的立法构想，认为目前经济犯罪立法中首 先应增设“禁止从事特定职业”的资格刑和专门针对犯罪单位的资格刑。总之， 对经济犯罪增设资格刑既是必要的也是可行的，应当及早提到立法日程上来。同 时，面对复杂的经济犯罪，应当将自由刑与财产刑、资格刑甚至非刑罚方法综合 适用，才能取得刑罚适用的综合预防功能；根据经济犯罪的具体情况合理设置， 逐步实现经济领域犯罪资格刑的扩大适用。 关键词：经济犯罪；资格刑；增设 I ABSTRACT The economic crimes is a serious social issue in the world. With the development of our country’s market economy, there are some new economic crimes in economical domain. Our country’s existing penalty system takes the free punishment as the center, and use the death penalty widely also. This kind of penalty system has the obvious insufficiency and the flaw regarding the punishment economic crimes. The qualifications punishment is a kind of effective penalty way in view of the economic crimes, but it is seldom utilized in the penalty economic crimes. Comparing to other three kinds of penalty methods, the qualifications punishment has delays the nature and the tenderness. Along with development of the penalty leisurely tendency, the qualifications punishment can receive more and more attention. To add economic crimes qualifications punishment is a question which is not only essential also urgently to be solved. This article was precisely complied with this tendency, to carry on the shallow analysis elaboration suitably to the economic crimes qualifications punishment establishment, hoping having a benefit to our country’s economic crimes qualifications punishment consummation.
