内容摘要 随着依法治国、建设社会主义法治国家进程的推进，我国加入世界贸易组织 后开放程度的进一步扩大，社会主义市场经济体制的不断发展和完善，司法执行 工作面临着前所未有的挑战和机遇。传统的民事执行制度存在与时代发展的不相 适应性，形势和任务决定民事执行必须进行改革。 本文以民事执行权的优化配置为突破口，首先介绍了民事执行权的基本理 论，包括民事执行权的内涵、特征、功能和民事执行权的性质学说，进一步明确 了其司法权和行政权的双重属性及民事执行权优化配置的价值取向和意义。其次 通过对国外民事执行权配置的比较分析达到借鉴国外优点弥补我国的不足的目 的。接下来介绍我国民事执行权配置的历史沿革及现状分析作为一个现实的铺 垫，引出文章的重心，关于民事执行权优化配置的设想。 目前在民事执行权优化配置的研究领域中，大多数学者将这个问题作为一个 方面来研究，但是实际上民事执行权的配置，不仅仅是一个方面的改革，它是通 过民事执行的管理体制、民事执行机构和民事执行权运行机制的研究来达到统一 我国民事执行权配置的最佳模式，这个问题的研究不应该是孤立的，而是与一系 列的改革紧密相联的，民事执行权配置的优化是需要这些方面的相应的改革来支 持的。 通过运用对比分析和历史的研究方法，作者从改革我国民事执行管理体制包 括民事执行的宏观行政管理和执行人员、执行装备和执行经费的管理；重置我国 高级、中级和基层人民法院民事执行机构；从民事执行权运行机制的目标模式和 实现这个目标模式的保障措施两个方面来完善我国民事执行权的运行机制，最终 得出统一我国民事执行权配置模式——民事执行权的分权运行和民事执行权配 置在我国的人民法院内部执行机构，即执行局和民事裁决庭。 关键字：民事执行权  民事执行机构  执行局  I Abstract Along with running a state by law, constructing socialism country, joining the World Trade Organization to open the degree the further expansion, and unceasing development and the consummation of social market economy system, the judicial enforcement work is facing the unprecedented challenge and the opportunity.
