论数据库法律保护模式-毕业论文.doc

摘  要 数据库的制作、编辑、传播和维护均需要付出大量的时间、人员和金钱。这 些投入主要用于对事实性信息的收集、核实与更新，以及对用户界面的设计。近 年来，数据库在生产生活中的地位越来越重要，然而我国对数据库却没有专门的 法律给予保护，即使在世界范围内，也没有统一的数据库法律保护规定。就目前 的理论研究而言，保护的范围、权利义务的内容、权利的期限等问题都没有达成 统一，因此本文决定对目前的各种法律保护措施逐一分析，找出各自优势和缺陷， 探寻一条适合中国国情的数据库法律保护道路。 论文指出了数据库有序性、独立性和可访问性的真正含义，明确了作品与数 据库的关系；数据库权利被明确为一种特别的知识产权，和传统的知识产权相区 分；对版权保护在原创性、保护范围、期限等方面遇到的重重困难，提出了独到 的见解；对数据库不正当竞争行为，给出了判断标准；在立法建议方面，由于特 别权利保护过分注重投资，论文设计了一系列制度，对投资者的权利进行了合理 的限制。 在结构上，论文首先明确了数据库的概念，界定了数据库的范围；紧接着指 出了法律保护的必要性；然后论文全面分析了版权、反不正当竞争法一般原则、 数据库特别权利等三种法律保护措施的内容与缺陷；然后根据数据库法律保护的 价值平衡原则，联系我国国情，论文最终提出了立法框架，建立“特别权利保护” 模式。 关键词：数据库；法律保护；版权；反不正当竞争法；特别权利 V ABSTRACT The development, compilation, distribution and maintenance of commercially significant databases require enormous investment of time, personnel and money to gather and verify factual materials, present it in a user-friendly way and keep it current and functional for users. It’s obvious that database will be more and more important for us. However, there is no any special regulation for database in China. Till now, there isn’t any worldwide treaty on database yet. Current research hasn’t drawn a uniform conclusion on the scope, rights and time limit of database. This article analyzed several legal protection measures and found their advantage and defect. It look forward to the establishment of legal frame on database. The seriation, independence and accessibility of database were confirmed. Database right was defined to a special intellectual property right. Those difficulty that copyright measure encountered were analyzed. The judging principles of unfair competition behavior were established. Sui generis right was reasoning limited in the suggestion of legislation. The article defined the concept and scope of database at the first, and then analyzed the necessity of legal protection. Three legal protection measures, including copyright, anti-unfair competition law principle, sui generis right were detailed compared. Finally, sui generis legal frames were broug
