中南民族大学硕士学位论文 摘  要 生命权是一切权利的基础，没有生命权其他权利无法实现，国际社会有关人 权宣言和公约以及一些国家的宪法都对生命权有明确的定义，中国的宪法学也应 该重视生命权的研究。生命权在现代宪法学视野中是人类享有的最根本的权利， 是构成法治社会的理性与道德基础，生命权所涉及的不单单是一个法律问题，它 触及社会各个领域，涉及多元价值体系，例如科学研究、伦理道德、人文文化等 等。生命权是至上的，是基本的，但也是最容易被公权力侵犯的，救济起来最显 无力，因为生命一旦失去无法挽回。生命权问题的背后实际上是一个宪政问题， 因此要在宪法中明确生命权的地位，这样其他部门法才能在纲领性的规定下对生 命权加以积极的保护。 进入 21 世纪的宪法理论，有必要重新回归到以人的尊严、人的生命价值为基 础的新的宪政理论，重新思考宪法框架中人的尊严问题、人的基本的价值问题。 生命权价值是人权价值中至上的、基本的、核心的价值，它本身的存在就是人的 基本价值。生命权价值的实现对于我国宪政发展有着重要意义，这也是生命权宪 政价值所在。 笔者赞同生命权应该是自然人享有的以其生命维持和生命安全为内容的人格 权。通过对生命权的介绍，主要探讨生命权的价值、生命权宪政价值以及生命权 价值实现过程中遇到的困境――当它与其他意识形态、价值元素发生冲突时如何 进行价值取舍。最后主张建立生命权秩序，形成良性法的法律文化对生命权进行 救济以实现其宪政价值。 关键词：生命权 生命权价值 宪政价值 价值冲突 生命权秩序 III 论生命权的宪政价值 Abstract The right of life is the base of all the other rights. Other rights couldnt be actualized without it. Regarding the right of life , there all has specific definition in the human rights and pact in the international society and also described in the constitution of some countries. Chinese constitution law should attach importance to the research of the right of life. The right of life is the most basal and essential right for the human being in the modern constitutional law, Its the rational and moral base which constitutes the nomocracy society. Its not only a law matter Which the right of life involved, it involves Multi-dimensional value system, e.g. science research, ethic, human culture and so on. The right of life is uppermost and the essential right, but it also always be infringed by Public authority and it will be powerless when relieving. It couldnt be retrieved when the life loosed. Actually its a constitution issue behind the right of life issue. So we should nail down the status of the right of life in the constitutional law, only that other department law could protect the right of life actively under the regulation of compendium.
