贵州省社会学 2009 年年会交流论文 论“人道主义干涉”的合法性 郜尔彬 摘 要：人道主义干涉已经成为国际法理论和实践上的焦点问题。它不但牵动着 最敏感的主权与人权的关系问题，也触及到正义与秩序这一对永恒矛盾的关系， 历来为各派学者争论不已。而某些国家以人道主义干涉为借口的军事行动也引起 了全球性的关注。本文基于客观广泛的分析，认为人道主义干涉有其历史渊源和 哲学价值；并通过定义、相关学说和国际法，论证人道主义干涉的合理性与合法 性。同时指出其文化与现实上的困境。在此基础上，为了保证人道主义干涉行为 顺利公正地实施，实现其真正的价值，本文提出了从原则和实践两个方面重建人 道主义干涉制度的建议。以期联合国体制下的集体人道主义干涉能够成为维护 人权的有力保障，同时避免沦为别有用心者的工具。 [关键词] 人道主义干涉 合法性 合理性 制度重建 The Legality of Humanitarian Intervention Abstract Humanitarian intervention has become the focus of international theory and practice. It touches on not only the most sensitive relationship between soveinty and human rights but also the perennial contradicting relations between justice and order. It has long been hotly debated by all sorts of schools. At the same time, some country using humanitarian intervention as an excuse to seek military actions has also attracted worldwide attention. Based on objective and extensive analysis, this article holds that humanitarian intervention has its origin as well as philosophical values. It demonstrated the rationalization and legality of humanitarian interventional and points out its cultural and realistic difficulties through its definition 、related theory and international law. In order to safeguard the smooth and fair practice of humanitarian intervention and to achieve its real value, this article comes up with suggestions on rebuilding humanitarian intervention system in the areas of principle and practice. By doing that, the collective humanitarian intervention under the system of the united nation will be able to safeguard human rights and avo
