摘 要 随着人工智能技术的不断发展，自动驾驶技术不再是空中楼阁，自动驾驶 汽车将出现在大街小巷，给我们的生活带来极大的便捷，环境污染问题在一定 程度上得到改善。但是，我们也不能忽视自动驾驶给我们带来的新的挑战，当 交通事故发生之后如何认定侵权主体问题成为法学界关注的热点。基于美、德、 英等国在自动驾驶立法方面的探讨，我国也应该学习、借鉴他们的经验，为我 国寻求新的立法出路。不难发现，我国应该借用“黑匣子”实时监控自动驾驶 汽车运行状况，在我国传统侵权责任法和产品责任法的基础上引进 SAE 分级明 细不同自动程度的侵权主体，同时引入英国的保险制度，为生产商、使用者分 担责任压力，促进自动驾驶技术的进一步发展。立足我国的基本国情，寻求符 合我们实际情况的立法出路。 关键词：自动驾驶技术；交通安全；侵权损害赔偿 Abstract With the continuous development of artificial intelligence technology, self-driving technology is no longer a castle in the air, self-driving vehicles will appear in the streets and alleys, bring great convenience to our lives, environmental pollution problems have been improved to a certain extent. However, we can not ignore the new challenges brought to us by autopilot. How to identify the subject of tort becomes a hot topic in the field of law when traffic accidents occur. Based on the discussion on the legislation of autopilot in the United States, Germany, Britain and others, China should also learn from their experience and seek a new legislative outlet for our country. It is not difficult to find out that our country should borrow the black box to monitor the running status of self-driving cars in real time, and introduce SAE classification with different automatic degree of tort subject on the basis of traditional tort liability law and product liability law in our country. At the same time, the introduction of the British insurance system to share the burden of producers and users, to promote the further development of autopilot technology. Base on our countrys basic national conditions, seek the legislative outlet that accords with our actual situation.
