山东建筑大学硕士学位论文的意见和建议：法律层面，《物权法》应明确“日照权”与土地使用权相关并建 山东建筑大学硕士学位论文 的意见和建议：法律层面，《物权法》应明确“日照权”与土地使用权相关并建 立地役权登记制度；日照标准层面，应学习日本，依据自然气候条件的特征，对 不同地区制定有针对性的日照策略和控制措施，使日照标准更具有可行性和合理 性；规划管理层面，规划管理部门应当重视公众参与制度的建设，更多地注重物 权保护，以尽可能减少权利纠纷。 关键词：日照权，日照控制方法，物权，权利界定，控制性详细规划 万方数据 山东建筑大学硕士学位论文Study 山东建筑大学硕士学位论文 Study on”sunshine right¨and its control method in urban planning from the Perspective of Property Right Si Peng(Urban and Rural Planning) Directed by Zhang Junmin ABSTRACT Shading-sunshine issue caused by the rapid urbanization and the big construction projects is increasingly serious these days．And in China sunshine on building is decided by the sunshine duration of building，SO the shading-sunshine issue of ground still remains unsolved．But the promulgation of“Property Law of People’S Republic of China’makes protection of private equity get more and more attention． This paper,inferred from the laws of Japan，America，German and France， interprets delineation of sunshine rights and the ways of sunshine contr01．At the same time，it analyzes and refers its advantages of laws．It introduces features of sunshine rights，a kind of adjacent relation，and explains definition modes of the current sunshine control in China from the property point of view．It also studies entitled ways of sunshine rights．It is concluded that sunshine rights of ground are entitled and controlled by regulatory plans from urban planning．However,the current sunshine control is based on buildings．It cannot provide the effective protection to sunshine rights of ground in regulatory plans． Therefore the paper analyzes cases of sunshine rights of ground，and studies divisions of sunshine rights of ground．Hours of sunshine rights of ground is defined from 1 l a．m．until lp．m．．according to the definition，the paper studies and constructs compiled regulatory plans and control ways of sunshine．Meanwhile，the influence of news ways to cities’and streets’forms will be discussed． At last，this paper states the existing problems of laws
