PAGE PAGE IV 地理标志产品保护制度比较研究 中文摘要 地理标志产品保护制度研究 中文摘要 地理标志一词最早又被称为“原产地名称”，是随着国际地理标志产品保护的发 展不断发展而形成的。经过近一个世纪的发展，地理标志已经形成一种完整的制度， 并且在社会经济发展、生态保护、提升就业、增加公众收入、文化遗产保护等方面发 挥着越来越重要的作用。2005 年 6 月 7 日，国家质检总局在综合国内外地理标志产 品保护措施的基础上制定了政府部门规章《地理标志产品保护规定》，该部规定 的出台表明了我国地理标志产品保护发展的新起点，也推动了国内地理标志产品保护 制度的进一步发展。 部门规章《地理标志产品保护规定》的制定和实施，促进了我国地理标志产品保 护制度的完善。但同时也形成了现行的《商标法》与《地理标志产品保护规定》两部 法律法规为主线的冲突性的地理标志产品保护模式，导致国内在申请人、权利所有人、 保护内容等方面的冲突，不利于我国地理标志产品的保护。 笔者以地理标志产品保护的相关概念等作为本文研究的理论基础，在此基础上对 我国地理标志产品保护制度的历史进行梳理，并对我国地理标志产品保护的现状进行 阐述，分析我国现行的两种保护体系存在的冲突，并对我国的地理标志产品保护申请 成功后的监督管理进行研究，分析我国制度体系中存在的问题，最后借鉴国际国外地 理标志产品保护的经验，完善我国地理标志产品保护制度。 关键词：地理标志；产品保护；制度冲突；完善对策 作 者：吴 霞 指导老师：周永坤 Abstract Protection system of geographical indication products comparative study Protection system of geographical indication products comparative study Abstract Geographical indications, the first word is also known as the origin of the name, formed with the development of the international protection of geographical indications products.
