虚拟财产的法律保护制度研究中文摘要虚拟财产是由于科技迅速发展而产生的一个新的法律概念。有关虚拟财产的相关问题 是目前我国法学界甚至是全世界法学界的一个热点话题。而由于虚拟财产有其独特的属性 和特征加之其本身尚在迅速发展变化未有完全稳定成型，另外法学界对其开展研究的时间 也比较短暂，有关于虚拟财产的财产属性、法律属性、权利归属尚未达成一个较为权威且 能让诸多法学家们都能认可的统一性认识，因此虚拟财产的相关法律保护制度也尚未完 善，本文主要研究我国的虚拟财产的法律保护制度。本文对虚拟财产的法律保护制度进行的研究可以分为以下五个方面： 第一部分是关于虚拟财产的概念以及虚拟财产的特征的界定。虚拟财产的概念可以分为广义的虚拟财产和狭义的虚拟财产，本文所指的虚拟财产为狭义的虚拟财产。虚拟财产 既有传统意义上财产的一般特征，也有其特殊的“虚拟”的特征。第二部分笔者对有关虚拟财产的财产属性、法律属性、权利归属的学说进行了介绍分 析并表明了自己的观点。第三部分简单的介绍了一下虚拟财产法律保护制度的域外立法例，其中既有网络游戏 和虚拟财产产生最早的美国立法例，也有网络游戏比较发达的日本、韩国以及我国的香港 台湾地区的立法例，并针对这些国家和地区的虚拟财产的法律保护制度进行简要的总结和 评价。第四部分中，笔者对我国的虚拟财产法律保护制度现状进行介绍并得出我国对虚拟财 产的法律保护方面近乎空白的最主要原因就是由于有关虚拟财产的财产属性、法律属性、 权利归属尚未达成一致认识，故而相对应的立法也就成了无源之水，无本之木，无法进行 下去，而后笔者又总结了一些次要原因。第五部分笔者提出了构建我国虚拟财产法律保护制度的初步设想，针对虚拟财产缺乏 保护的原因提出了解决问题的方案。关键词：虚拟财产财产属性法律属性权利归属立法保护The legal protection of virtual property SystemAbstractVirtual property is a new legal concept arising as a result of rapid technological development.
