AbstractWiththegrowinglegalawarenessamongpeople,thecircumstancesofappealingagainstthecriminalrulingandverdictsofPeople’sCourtarerising,sowiththecallingforproceduraljustice.Asoneoftheprerequisiteforinitiatingreviewingprocedure,reviewingofcriminalappealconductedbyprocuratorialorganspossessesthefunctionofdistinguishingthefacts.Whereas,thecurrentprocuratorialorgansarerevealingtheirdefectsintheprocessingprocedures,tociteafew,theproblemsofdifficultiesfortheregistrationandacceptanceanderror-correctioninreviewingcasesaresevereandawaitsforreform.ThroughstudyingonthecurrentrunningofprocuratorialorgansofChinaintheircriminalreviewingprocedures,thispaperputsforwardproblem-focusedconcretevisionforrestructuringthereviewingprocedureofourcountry’scriminalappeals,thustocarryoutthelegalsupervision,legaljusticeandhumanrightprotectionfunctionsofjudicialactivitiesbyprocuratorialorgans.Apartfromtheintroduction,thispaperconsistsoffourpartswithatotalofmorethanthirtythousandwordsinthemainbody.Thefirstparthasmainlyexpoundedontherelativeconceptsandnatureofprocedureofcriminalappealingreviewing(PCAR).Tobeginwith,tostudythegeneralconceptsandtosummarizethethreecharactersoftheprocedure,i.e.,absenceofrelevantprovision,theobjectiveexistenceinjudicialpractices,andthedualnatureforterminatingreviewingandinitiatingretrial;Secondly,toconductthepropertyanalysiswhichconsistsoftwoparts:thedefinitionofthelawsuitrightsfor“appealing”aswellastheconcreteanalysisofPCARpropertycombinedwithtrialsupervisionprocedure.Atlast,todefinitetheimportanceofPCARincriminallawsuitsbystudyingitsvalue.ThesecondpartinvestigatesontheoperationalmodeandeffectsofPCARcarriedoutbyprocuratorialorgans.Inthispart,withaviewtolegislation,thepaperhasintroducedfourphasesofPCARrespectively,namely,theacceptancephase,registrationphase,reviewingphaseandconclusionphasebyfocusingonprocessingofreviewingworks.Afterthat,thepaperanalyzedthecurrentrunningstatusofPCARthroughdataanalysis.ThethirdparthasconcludedthefundamentaldefectsofPCAR,tobeexact,theproce
