AbstractArbitrationandmediationproceedingsexceptintwoofthemostwidelyusedmechanism for dispute resolution,hasadifferentstatus,roleandfunctions.Withthe emergenceofalarge numberofsocialdisputes,arbitrationandmediationinthedisputeresolutiondeficiencies graduallybecomethebottleneckoftheirowndevelopment.ArbitrationandMediation combineitcombinestheadvantagesofbotharbitrationandmediation.Ascanbeseenfrom thenationallegislativebodiesandalltherelevantrulesofarbitration,arbitrationand mediationisaspecialcombinationofhybridADRincreasingpopularity,moreandmore privatedispute resolutionlawyershavegraduallybecomeaware ofitsapplicabilityand effectiveness.MediationinthearbitrationsystempioneeredinChina,becauseofitsrespect forpartyautonomyinthedisputeresolutionprocess,thefocuswastomaintainthebusiness relationshipbetweenthetwosides,thepartiessavetime,energy andmoneyaswellashaving thecharacteristicsofflexibilityandfinality,graduallyrulearbitrationlegislationand arbitration bodies used bymanycountries.Arbitrationandmediationhavebeenabletocombinetworeasons:Ontheonehand,due tothepartiestodisposeoftheirrights,thepartiestothearbitrationandmediationcangive eventhecombinationofarbitrationtoresolvedisputes.Whilerespectingpartyautonomy,the partiesmaintaincommercialcooperationbetweenthetwosidesisthecombinationof arbitrationandmediationabigadvantage.TheArbitrationandMediationcombiningthe second-largestpartyadvantageissavingtime,effortandmoney.Meanwhile,arbitrationand litigationprovidedfinalityrefereerelativelyinflexible;mediationflexibility,butcannot guaranteetheagreementreachedwithafinalexecution;andarbitrationandmediationisable to achieve a combination offlexibilityand finalitydual objectives.However,in viewofourcountryandin manyothercountries,includingtheworld for internationalarbitrationprovisionsmademostlytooroughmediation,arbitrationresultsare sometimesunconvincing.Therefore,inordertomeetChinasgrowingnumberofdispute resolutionneedtoimprovethecredibilityofthearbitrationagreementinmediationandb
