论网络虚假信息传播的法律规制 摘 要:网络信息传播是一种新型的信息传播方式，网络虚假信息就是借助互联网制造和传播的与事实不符的信息。网络的发展使网络环境中信息失实的现象愈加严重。我国网络信息传播存在现有法律针对网络虚假信息传播的法律体系与责任体系不健全，尤其是处罚力度轻，对虚假信息的制造者、传播者起不到震慑作用。而在受害人的诉讼救济上，由于使用网络匿名，无从获取侵权人的信息进而不能有效维护受害人的合法利益。另外，政府信息公开制度不健全、网内企业行会管理水平低等问题也为虚假信息的传播提供了可乘之机。因此，确有必要对网络虚假信息传播进行法律规制，进一步完善法律体系与责任体系，加强立法保障，完善受害人诉讼制度，建立健全政府信息公开制度，明确政府监管、网站排查、个人自律的责任，加强社会普法力度，从而确保网络环境的和谐与健康。 关键词：网络虚假信息 法律规制 责任承担 The legal regulating of the theory of network spread false information Abstract:The network information transmission is a new way of information dissemination.
