[内容摘要] 言论自由作为基本人权已被世界各国用宪法的形式加以保障。由于新闻传媒信息传播广泛、社会影响力大，日渐成为人们表达言论的重要工具。于是，世界各国用新闻立法的形式去保障言论自由权、新闻自由权、知情权等各种涉及言论自由的权利。由于种种原因，我国《新闻法》至今还未出台，有限的涉及言论自由的法律、法规已不能适应时代的需求。本文从界定言论自由的概念和内涵入手，阐释言论自由和新闻立法的密切关系以及新闻立法的意义，分析新闻立法困境，并结合我国实际情况，对加强新闻立法、保障言论自由进行合理的思考。 [关键词] 言论自由权 新闻自由 新闻立法 [Abstract] Freedom of expression as a fundamental human right has been used around the world in the form of constitutional protection. Because of extensive news media dissemination of information, social influence, increasingly become an important tool to express their views, therefore, all countries in the world with news in the form of legislation to protect the right to freedom of expression, freedom of the press, the right to know and other rights related to freedom of expression. Due to various reasons, Chinas press law has not yet promulgated, relating to the limited freedom of speech laws and regulations can no longer meet the needs of the times. This article defines the concept and meaning to freedom of expression start to explain the close relationship between the freedom of speech and press and the Legislative Council, as well as the significance of news, analyze the present plight of legislation and rationally think about strengthening of the legislation and protection of freedom of speech, combined with Chinas actual situation.
