大学生科研创新项目研究报告 项目名称： 污染环境罪研究 项目类型： 一般项目 项目年度： 2013年 项目负责人： 李思美（学号：32012100014） 负责人院（系）： 法学院 专业（方向）： 法学 项目组成员： 李依朔、王昭宇、王祎、王诺雅 指导教师： 王剑波 副教授 教务处 制 二〇一四年 摘要 在我国的刑法上，对污染环境之行为的认定、法律责任等，已经都有相关的规定和界限，可是在很多方面都没有给公民及企业单位一个清晰的定义。包括对“有害物质”的界定方式、对污染环境的行为危害程度的界定等，并不能给公民和企业单位一个明了的度的限定，以至于在很多时候，个人和企业组织对环境污染行为无法形成一个正确的认识，从而无法知道其行为的危害性、后果的严重性以及自身承担责任的沉重与严峻。我们在一些企业、一些公共场所的行人之间作了调查，参考了一些书籍和资料，对污染环境罪有了一个基本全面的了解，对其中各个要素，此罪的认定等问题进行了学习和分析，与大陆法系的相关罪行进行了对比和参照，结合现实相关事件和需求，对上述存在本组对个别不合理或是不完善的地方提出了自己的浅薄见解，下面便是具体的研究与分析成果。 关键词：污染环境罪 污染 犯罪 立法 Abstract In our criminal law, there are relative stipulations and limitation in determining the actions of environmental pollution and in affirming legal liabilities. However, clear definition has not been determined in aspects of legal responsibilities that civics and enterprises. Because including the defining determinism of hazardous substance, and the extend injury to the whole society which werent clearly defined and given limitation of , so as to in many circumstances the civics and the entrepreneurial organizations cant originate the correct recognition of their own critical negative affects on overall impact and severity consequences of environmental pollution. We designed research questionnaires, surveys have been conducted among pedestrian in public areas and further analysis and later reaches the current situation. Also the references of literatures and materials foster us a basic understanding of research on pollution crime. To which the study and analysis of elements, such as the cognizance of this crime, have carried on throughout the process. We came up with our own superficial opinions towards the irrationalism and drawbacks on the basis of the comparison with the continental law system and the combination with the relevant events and demands.
