1. ------IND- 2012 0237 HU- EN --------- --- PROJET Government Decree No …/2012. (… …) amending Government Decree No 253/1997. (XII. 20.) on the national requirements regarding town planning and construction Pursuant to the authorization granted under Article 62 (1) g) of Act LXXVIII on shaping and protecting the built environment, and acting within the scope of competences defined under Article 15 (1) of the Basic Law, the Government hereby declares the following: Section 1 (1) The following provision shall replace Section 50 (1) of OTéK: “(1) The design programme is a text document that contains the definition of the basic requirements set for edifices, and the quantitative and qualitative details of the developers expectations laid down in the design contract. The design programme may establish requirements that are stricter than those laid down in this Decree.” (2) The following provision shall replace Section 50 (3) of OTéK, and the following section (3a) shall be added to Section 50: “(3) In accordance with their intended purpose the edifices must meet the basic requirements of a) stability and mechanical resistance, b) fire safety, c) hygiene, health and environmental protection, d) safety in use and accessibility, e) protection against noise and vibration, f) energy economy and heat retention, g) protection of life and property h) sustainable use of natural resources and the expectations laid down in the design programme. (3a) The basic requirements can be fulfilled by applying the relevant Hungarian national standards or through another solution that ensures an at least equivalent fulfilment of the requirements. Edifices shall be designed and built by ensuring the possibility of installing and connecting the equipment of renewable energy sources - the type of which is defined in the design programme - without significantly disturbing the structure of the edifice.” (3) The following provision shall replace Section 50 (5) of OTéK: “(5) The e
