东北农业大学学士学位论文 　　　　　　　　　　学号：夫妻忠实义务的法理学思考 Husbands and wives faithful duty jurisprudence ponder 学生姓名：荆丽 指导教师：李友霞 所在院系：法学院 所学专业：法学 研究方向：婚姻法 东 北 农 业 大 学 中国·哈尔滨 2009 年 5 月Northeast Agricultural University Bachelor dissertation Student Number： Husbands and wives faithful duty jurisprudence ponder Candidate： Supervisor： College：Specialty： Northeast Agricultural University Harbin China May 2009 摘要 在各国《婚姻法》的修订过程中，夫妻的忠实义务都受到普遍的关注，在我国也不例外。虽然这一问题因新婚姻法的颁布而暂时告一段落，但对“夫妻忠实义务”的更宏观上的认识才刚刚开始。夫妻忠实义务，就是指夫妻双方在共同生活中应当互相忠实以维护婚姻关系的专一性和排他性。在我国早期，忠实义务是强加给女方单方的义务，随着社会的进步，立法的逐渐完善，夫妻忠实义务也更加科学，更加合理。作为配偶权的一项重要内容，夫妻忠实义务具有着人格权的性质，同时又是一种人格化的身份权。也正因为夫妻忠实义务在家庭这种社会关系中凸显出越来越重要的作用，其对于社会的价值体现的也越来越明显，然而我国《婚姻法》对此的规定仍然属倡导性条款，并不能从法治的角度对违反一方做出具体的处理，因此，尽早解决立法中不完善的问题就显得尤为重要，本文从夫妻忠实义务的基本定义，法律性质定位，社会价值等方面做了详细的探讨，并针对立法中存在的问题提出了对应的解决对策，期望能为这一问题的解决和完善提供参考。 关键词：夫妻忠实义务 法律性质定位 价值分析 解决对策 Abstract In each country, Marriage amendment process, the husband and wife are subject to the general duty of loyalty concerns, in our country is no exception. Although the issue of the promulgation of the new marriage law temporarily come to an end, but the duty of loyalty husband and wife and a broader understanding of the only just begun. Husband and wife duty of loyalty, that is, refers to both husband and wife living together shall be faithful in order to protect the marital relationship and exclusive specificity. Early in our country, faithful to the womans obligation is to impose unilateral obligations, along with social progress and improvement of legislation, duty of loyalty couple more scientific, more reasonable. As the spouse of an important right, Faithful husband and wife have an obligation to the nature of the right personality, but it is also right in his capacity as a personification. It is because of husband and wife in the family duty of loyalty in the social relations that highlight the increasingly important role, and its value for society is also reflected in more and more obviou
