  提要  长期以来，人们对文化产业的发展关注度很高，但多集中在技术、人才、产业创 意等层面，对文化产业制度的关注较少或不全面，文化产业制度是约束文化产业形成 与发展的众多要素的总和，这些要素构成一系列规则，来对文化产业的发展进行约束。 本文力图对比国外文化产业制度的异同，来界定文化产业制度的概念，并从此处 入手，说明文化产业制度作用可以避免市场失灵，能够降低文化产业的经营成本。在 此基础上概括我国文化产业发展的现状，比较国外文化产业制度，以美国、英国、法 国、加拿大的文化产业制度作比较，提出完善我国文化产业制度的主要措施，在以下 六个方面：文化产业应走市场化道路、健全文化产业的投资机制、加强政府的指导作 用、完善产业的法律法规、广泛设立产权交易市场、培养创新人才。 本文的创新之处在于： 首先，参酌比较各种文献，理清文化制度和文化产业制度的不同，主张多以经济 价值看待文化产业，把文化产业和文化事业区分开来。 其次，按照制度经济学理论，在文化产业制度中融入创新激励机制，针对文化产 业融资难的问题，主张把国家新提法文化产业可以以产权融资制定在制度中。 最后，多制定有关规范文化产业发展的法律法规，把文化产业发展纳入法律轨道， 既符合我们依法治国的方略，也改变以往政府对文化产业的过多干涉，丰富社会主义 市场经济制度。 关键词：文化产业  制度  我国文化产业制度  第 I 页 共 38 页     Summary Long-term since, people on the development of cultural industry of the high degree of concern, but more focused on technology, talent, industry and creative aspects of cultural industry system, with less attention or not comprehensive, cultural industry cultural industry system is constrained in the formation and development of a series of rules.
