民事送达论文：我国民事诉讼中送达问题的研究 【中文摘要】在民事诉讼程序中,送达是联系人民法院和当事人之间的桥梁,是当事人获取诉讼信息的渠道,几乎每个环节都离不开送达,没有一个问题像送达这样牵动着整个诉讼程序,因此,民事送达制度是民事诉讼制度的一个重要组成部分,对于保证诉讼程序流畅运行意义重大。但,随着社会经济的发展和科技的进步,民事送达制度由于设计上的疏漏和操作中的不当使得“送达难”问题日渐凸显,制约并阻碍了人民法院审判工作的顺利开展。在进一步推进民事诉讼审判方式改革的今天,程序保障和司法效率理念正在引起越来越多的社会关注,而这也应成为民事送达制度改革的主旋律。为寻求解决“送达难”问题的出路,不少学者、司法实务界人士做出了种种努力,如何科学建构我国的民事送达制度,如何确保实践操作中严格遵守法律规定,是我们所面临的一个重要课题。本文采用实证分析、比较研究的方法,对民事送达制度进行从理论到实践的梳理,对我国民事送达制度中存在的与市场经济发展的同步性问题、与诉讼价值的协调性问题、立法缺陷问题、实际操作性问题进行了逐一的阐述与分析,指出现行民事送达制度的立法指导思想的偏误,对我国民事送达制度的完善进行了初步的思考。 【英文摘要】In the civil Procedure, the service is the bridge between the court and Parties, it is the channel for the Parties to acquire Procedure messages, almost every link can’t exist without the service, there is not another question like service that is concerned the whole Procedure, so the system of civil service is the important constituent of the civil lawsuit system, it is very important in guaranteeing civil procedure operated smoothly. However, with the development of economy and the advancement of science and technology, the defect of the service system and the impropertion of procedural operation began to surface, gradually to limit and block the try works of the people抯 court. As the reform of civil Procedure goes further today in our country, the idea of procedure ensure and judiciary efficiency is now attracting more and more social sights, and this idea also will become the theme of the reformation of the civil service of process. In order to resolve the problem of service, some scholars and judgments have made every kinds of effort, because of the limitation of present laws, they can抰 make any greater progress. How to design the civil service of Process scientifically, how to make sure the laws are observed strictly by peoples in the practice is one big problem that we have to face up.
