内容摘要 毒品犯罪危害较大，是我国重点打击对象。目前的毒品案件的趋势是涉毒数量越来越 大，行为方式越来越隐蔽，涉毒人员反侦查手段越来越强，给公安机关抓获罪犯、收集证 据带来一定困难。对于抓获并起诉的毒品案件，也可能存在罪名、数量、未完成形态、共 同犯罪等法律事实的认定，证据的收集、分析及采信，法律理解及适用等司法疑难问题。 本文借助某法院审理的张某、侯某走私、贩卖、运输毒品的案例，通过案例分析的形 式，对毒品犯罪在司法实践中遭遇的疑难问题进行梳理，分析该案所争议的罪名的认定、 毒品数量、纯度的认定、共同犯罪的主从犯认定等问题及相关法律适用，同时对毒品犯罪 案件的证据问题进行探讨。 全文分为三大部分，约18000 字。 第一部分，基本案情与争议焦点。介绍张某、侯某走私、贩卖、运输毒品案的案件经 过及判决情况，整理出本案的争议焦点。 第二部分，分析刑法争议的问题。结合案例的争议焦点，对涉毒行为的定性、共同犯 罪中主从犯的认定、毒品数量及纯度的确认、贩卖、运输毒品的既未遂认定及死刑的适用 几个方面进行分析。 第三部分，探讨毒品案件证据的疑难问题。主要对侦查阶段收集证据的困难及问题、 审判阶段证据的认定及运用问题，进行理论与实践的探讨。 关键词：毒品犯罪，法律适用，证据，司法实践 Abstract Drug crime harms the society to a great degree and it is the key target for the government to strike. The trend of the current drug case is the increasing number of drugs, behavior is getting more and more covert, drug-related personnel anti-detection means are more and more strong. It brings certain difficulties to public security organs to capture of criminals and collect evidence. Some problems exists in the captured and prosecution of drug cases, such as there may also be charged, volume, unfinished form of crime, legal facts, evidence collection, analysis and adoption, legal understanding and application of judicial problems. This paper, by means of the case of Zhang and Hou smuggling, trafficking in and the transport of drugs, analyzes in the form of the drug crime in judicial practice and the problems encountered in the review, analysis of the controversial crime cognizance, amount of the drug, purity identification, common crime master make identified issues and related law, at the same time discuss on the drug crime case evidence problems.
