关于用人单位违法解除劳动合同的相关法律问题思考 摘 要 《劳动法》、《劳动合同法》在赋予劳动合同法律约束力的同时，也赋予了劳动 合同当事人的单方解除权，具体规定用人单位单方解除劳动合同的法定条件，还特 别限制了用人单位不得单方解除劳动合同的情形。规定劳动合同当事人解除劳动合 同时，必须符合法律规定的条件，履行法律规定的程序。但是，在当前劳资双方形 成明显强弱对比的大环境下，加之用人单位内部缺乏劳资抗衡机制、劳动者权利意 识淡薄，以及劳动法律、法规、规章存在缺陷、不足和冲突，一些用人单位随意强 势地解除与劳动者依法订立的劳动合同，严重损害了劳动者的合法权益，损害了劳 动合同的严肃性，最终损害了国家法律的公信力，产生了一些不稳定因素。 本文就用人单位违法解除劳动合同的现状和产生原因、以及改善意见做了归纳 总结和分析；在改善劳动力供需不平衡、强化劳动者维权意识、建立健全企业内部 抗衡机制和完善劳动法律、法规、规章存在的缺陷、不足和冲突四大方面提出了自 己的见解。 关键词： 劳动合同 违法解除 供需失衡 抗衡机制 II 关于用人单位违法解除劳动合同的相关法律问题思考 Abstract “Labor Law , Labor Contract Law in the labor contract to give legally binding, but also gives the parties the unilateral right to terminate the labor contract, the specific provisions of the employer unilaterally terminate labor contracts statutory requirements, specifically limit the employer shall not unilaterally terminate the labor contract situation.
